Terms & Conditions for Desert West Auction eBay Live Auctions: Terms: All merchandise is sold as is, where is to the highest bidder. Neither we, nor the consignor make any warranties or representations with respect to the correctness of description, genuineness, attribution, provenance, period, culture, age, source, origin, authenticity, or condition of any item sold. All statements, written and oral, are the opinion only of Desert West Auctioneers.
*** If an item is materially different than was described by the Seller, Buyer shall have 48 hours from the date the property is received to notify the Seller. After the 48 hour period all items are considered as is, without recourse.
*** By bidding in this auction you are entering a binding legal contract to pay for your items within 1 week of the close of the auction. Non payment will result in a non pay warning and forced relisting of the items you were the highest bidder on. You represent that you are over the age of 18 and can enter into legal contracts.
*** The highest bidder acknowledged by the auctioneer shall be the purchaser, regardless of the time the bids were placed. In the event of a tie between bidders, the auctioneer shall have the sole and final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises after sale, the Company's sale record shall be conclusive in all respects.
*** Specific Lot Questions: All inquiries regarding lots for sale must be received 24 hours prior to the start of the auction. Please register to bid and logon to Live Auctions 1 hour before the start time.
*** Payment: We honor American Express, Master Card, Visa, Money Orders, Cashiers Checks, and PayPal. Winning bidders must log on to the PayPal web site directly and request payment to be sent to desertwest@desertwestauction.com . Personal checks will be honored with a fifteen day waiting period for our local bank to clear your check. New Mexico Sales Tax will be charged on items delivered within New Mexico, unless an NTTC is on file at our office.
*** Buyers Premium: A buyers premium of 15% will be added to the final bid amount on all items purchased on eBay Live Auctions. Please note - Live Auctions are invoiced differently than normal eBay transactions. Please allow 3 days for us to invoice for your winning items.
*** Shipping: We combine shipping for multiple purchases where possible. All shipping is at the buyers expense. See item description (shown as: SHI $ 0.00) for Contiguous U.S. shipping, handling, and insurance charges, unless stated otherwise (Alaska, Hawaii, Puerto Rico, etc please contact us). International Bidders must contact us directly for shipping, handling, and insurance costs, item shipping amounts in description of items are not correct for Int'l bidders. LOCAL PICKUP ITEMS cannot be shipped, they must be picked up in person at the Auction House.
*** Return shipping of items to us must be preauthorized and is at the buyers expense.
