Payment Details/Terms and Conditions
1. Payment of purchase price
Payments from Germany will only be accepted in advance by bank transfer. The prices are fixed prices, so no price negotiations will be undertaken. You will receive a VAT invoice.
Payments from other countries will only be accepted in advance using PayPal.
The payment is to be made within 10 days of the end of the auction or the selection of the “buy it now” option. If no payment has been received by the end of this period, then the vendor specifically reserves the right to sell the article elsewhere or to cancel the contract.
Duties and taxes, which may be due in international trade, are in all cases to be borne by the customer.
2. Delivery
The dispatch of the goods in an insured parcel will take place within 10 working days of the receipt of payment by the vendor. This will be in Germany by UPS and in other countries by DHL or FedEX.
In case the customer does not accept delivery of the goods immediately on arrival, then all resulting costs are at the expense of the customer. Hipp Endoskop Service GmbH reserves the right to sell the goods to third parties or to hold the original customer liable for any loss.
3. Transfer of risk
If the customer is a consumer, then the risk of accidental destruction or accidental damage of the article sold transfers to the customer with the handover of the article to the customer. This also applies to mail order sales.
If the customer is a business, then the risk transfers to the customer as soon as the dispatch by Hipp Endoskop Service GmbH or the supplier of Hipp Endoskop Service GmbH has been handed over to the person responsible for transport or has left the stores of Hipp Endoskop Service GmbH for the purpose of dispatch or has left the stores of Hipp Endoskop Service GmbH. In case the dispatch is impossible at no fault of Hipp Endoskop Service GmbH, then the risk transfers to the customer with the reporting of readiness to dispatch.
If the customer delays accepting delivery, this also counts as handover.
4. Guarantee
The guarantee period is 2 years from the transfer of risk. The period is limited to 1 year for used goods. This period also applies to claims for compensation of damage resulting from defects, as long as no claims are made resulting from unauthorised actions.
5. Right of cancellation / consequences of cancellation
Consumers can cancel their contract declaration within two weeks without stating the grounds in text form (e.g. letter, fax, Email) or by sending the goods back. This period begins at soonest with the receipt of this instruction. If the cancellation, or the article itself, is promptly sent, then this suffices to maintain the cancellation period. In case of a valid cancellation, services already received by both sides are to be returned/reinstated. Articles, which can be sent in a parcel, are to be sent back to Hipp Endoskop Service GmbH. If the consumer can only return the services received incomplete, or partially, or in damaged condition, then he shall, if necessary, compensate Hipp Endoskop Service GmbH for the reduction in value. Where articles are relinquished, this does not apply if the damage results exclusively from testing – as would have been possible in a shop.
The consumer can also avoid the duty of compensating the value if he does not put the article into use like an owner and does nothing that might affect its value. With a return of part of a goods delivery whose total order value amounts to up to 40.00 Euro, the consumer has to bear the costs of the return, if the article delivered corresponds to that ordered. Otherwise, the return is free for the consumer.
6. Right of return
Business customers only have a right of return based on the legal cancellation right for consumers under the limitation that the shipping and packing costs for sending and for sending back are to be borne by the customer in every case.
7. Data protection
The customer explicitly agrees, with the making of a bid, to the recording, processing and use of personal data.
8. Title to goods
If the customer is a consumer, then Hipp Endoskop Service GmbH retains ownership of the item purchased until the complete payment of the purchase price. If the customer is a business, then Hipp Endoskop Service GmbH retains the ownership of the article purchased until receipt of all payments resulting from the business relationship with the orderer.
9. Applicable law, Court of jurisdiction, Partial invalidity
The law of the Federal Republic of Germany applies to these business conditions and to all business relationships between Hipp Endoskop Service GmbH and the customer.
Place of fulfilment and court of jurisdiction are for both parties, Hipp Endoskop Service GmbH and customer, the place of business of Hipp Endoskop Service GmbH, so far as an agreement of place of fulfilment and court of jurisdiction is legally permissible.
