Bids left with ebay are not the same as absentee bids left with the auction company. Ebay bids are bid live against the auction floor and are not presented to the auction house in advance. All Ebay bids are executed at the time of auction and not at the time you leave your bid.

Please register early to bid to avoid bidding delays. There will be no manual approvals after the auction starts.

1. It is our intention to call out any defects that we know about. However, all items are sold as/is, where/is. Know what you are buying! It is the bidders responsibility to determine the condition of the item. You are the sole judge of what any item is worth and you must decide what you are willing to pay for it. We disclaim any responsibility for any opinions on the value of any item whether expressed by the auctioneers or others. All sales are Final.

2. This information is for the purpose of identifying the merchandise only. Although obtained from sources deemed reliable, the auctioneer makes no warranty or guarantee expressed or implied, as to the accuracy of the information contained in this catalog. It is for this reason that buyers should avail themselves of the opportunity to make inspection prior to the sale. Condition statements are not provided on every lot. Missing condition statements do not mean the item is perfect. All items are sold as/is. You may call 651-484-1415 for requests for condition of a particular item at least two hours prior to auction start. These verbal statements are an opinion only and are not guaranteed. Rose Galleries will have no responsibility for any error or omission.

3. Neither Rose Galleries nor the consignor make any guarantees, warranties or representations, expressed or implied, as to the property or the correctness of catalog or other description of the authenticity of authorship, size, quality, condition, rarity, provenance, importance, value, medium, age, genuineness, signature, inscription, or otherwise. No statement anywhere, whether oral or written, shall be deemed such a guarantee, warranty or representation. Rose Galleries does not guarantee the authenticity of any signatures.

4. Online bidder payment must be made by either Paypal or check in US funds. Rose Galleries reserves the right to hold merchandise until a check payment has cleared.

All items must be paid in full and removed from the building within ten days following the auction. No merchandise may be removed until paid for. Title passes to the buyer when the auctioneer says "sold". The items are stored AT YOUR RISK. Rose Galleries shall have no liability for any theft, loss or damage to property left on the premises. All deposits will be forfeited if the items have not been removed from the premises within 20 days. All items paid for and not picked up within 20 days following the auction will be sold as a consignment on a future auction with all commission, balance owed and storage fees being taken from the proceeds before payment to the consignor.

5. In no event shall Rose Galleries be liable to any purchaser for any amount in excess of that paid by the purchaser.

6. Rose Galleries will ship only small items that are easily packaged and do not require special handling. Estimates of shipping charges are available at 651-484-1415. Packing and handling of purchased lots by Rose Galleries is at the entire risk of the purchaser and Rose Galleries will have no liability for any loss or damage to such items. Any insurance you request for your shipment will be insured through the shipping carrier and not through Rose Galleries.

If you purchase a larger or fragile item or any furniture item you must arrange for your own shipping directly with a shipper of your choice. You must provide authorization including your name, sale date, lot numbers to release to the shipper and the name of the shipper coming to claim your items. Rose Galleries will not be responsible for the acts or omissions of carriers or packers of purchased lots, whether or not recommended by us. Items not picked up on time may be subject to storage and handling fees as per Rose Galleries' terms and conditions.

7. Jewelry is guaranteed to be as cataloged except as follows:
Colored stones are not guaranteed to be natural or treated.
All measurements are approximate and are guaranteed to within 10%.
All stone gradings are given as a courtesy to the bidders and are not guaranteed.
All weights are for the entire piece and include all stones or workings.
All watches are sold as/is -we do not guarantee their condition, gold content or mechanical ability.
Rose Galleries does not guarantee any information contained in outside appraisals.

Items marked as tested gold are not marked but have been tested for gold content.

If an item must be returned because it is not as cataloged (i.e.. gold content, diamond, etc) the auction company must be notified within one week of the auction date. After that all sales are final. No adjustments can be made on any piece that has been altered.

8. Minnesota sales tax of 6.5% will be charged to the buyer on all sales and buyers premium unless a current tax exempt number is provided and a MN form ST3 is filed with the auction company or the item is being shipped directly out of state.

9. As a service to our customers who cannot attend the auction, Rose Galleries accepts absentee bids in person and by fax directly with the auction company as well as the online bidding. Bidding is done competitively with the live auction. In the event of duplicate bids, the earliest bid takes priority. In the event of tie bids between absentee and online bidders, absentee bids submitted directly with Rose Galleries will take priority. The auctioneer has final discretion to determine the successful bidder or to reoffer a lot in dispute.

10. Some lots in this sale may be offered subject to a reserve. The reserve is a minimum price agreed upon by the consignor and Rose Galleries below which the item will not be sold. The reserve will be no higher than the low estimate given for the piece.

11. Employees of the auction company are not prohibited from bidding on property. In the course of their employment it is possible they may have access to information not available to the public.

12. The auctioneer reserves the right to reject any and all bids, as well as the right to refuse to acknowledge any bidder. Under no circumstances are the consignors or the consignors agents or persons acting on behalf of the consignors permitted to bid at the auction on their consigned property. The auction company reserves the right to withdraw, combine or divide any lot prior to the commencement of bidding.

13. A 20% buyer's premium will apply on all purchases made via eBay Live / Live Auctioneers.

14. Bidding on any lot automatically constitutes agreement and acceptance of the terms and conditions.
